Une requ\u00eate en contestation d\u00e9pos\u00e9e \u00e0 la cour constitutionnelle"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Une requ\u00eate a \u00e9t\u00e9 d\u00e9pos\u00e9e \u00e0 la cour constitutionnelle ce lundi 23 octobre 2023, en contestation de la validit\u00e9 de la candidature de F\u00e9lix Tshisekedi \u00e0 l\u2019\u00e9lection pr\u00e9sidentielle de d\u00e9cembre prochain en R\u00e9publique d\u00e9mocratique du Congo (RDC).<\/strong> <strong>L&rsquo;initiation vient de Seth Kikuni, un autre candidat pr\u00e9sident de la R\u00e9publique. <\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour le pr\u00e9sident du parti politique Piste pour l&rsquo;\u00c9mergence, lors de l&rsquo;\u00e9lection de 2018, l&rsquo;identit\u00e9 qui a \u00e9t\u00e9 reconnue par la cour constitutionnelle est celle de F\u00e9lix Tshisekedi Tshilombo et non F\u00e9lix Antoine Tshisekedi Tshilombo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>\u00ab(\u2026) Or, il ne fait aucun doute que par ses arr\u00eats sous RCE O01\/PR et RCE 002\/PR du samedi 19 janvier 2019 inattaquables par nature, votre haute cour a proclam\u00e9 \u00e9lu Pr\u00e9sident de la R\u00e9publique D\u00e9mocratique du Congo, Monsieur Tshisekedi Tshilombo F\u00e9lix et que le pr\u00e9tendu Tshisekedi Tshilombo F\u00e9lix Antoine n&rsquo;a jamais \u00e9t\u00e9 pr\u00e9sident de la R\u00e9publique D\u00e9mocratique du Congo et ce au regard desdits arr\u00eat\u00e9s<\/em>\u00ab\u00a0, explique le candidat malheureux \u00e0 l&rsquo;\u00e9lection pr\u00e9sidentielle de 2018.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Seth Kikuni estime que sa requ\u00eate demeure recevable et sera d\u00e9clar\u00e9e fond\u00e9e comme telle du fait qu\u2019elle ob\u00e9it aux conditions li\u00e9es \u00e0 la qualit\u00e9 et \u00e0 la capacit\u00e9 du requ\u00e9rant, \u00e0 l\u2019int\u00e9r\u00eat et au d\u00e9lai de l\u2019action.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Le leader du parti politique Piste pour l&rsquo;\u00c9mergence attend de la cour ce qui suit :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Dire la presente action et amplement fond\u00e9e;<\/strong><\/li><li><strong>D\u00e9clarer la candidature de F\u00e9lix Antoine Tshisekedi Tshilombo irrecevable, partant la rejeter<\/strong><\/li><li><strong>Frais comme droit.<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Il sied de noter que par son R\u00e8glement int\u00e9rieur, adopt\u00e9 le 30 avril 2015 et publi\u00e9 au Journal officiel le 22 mai 2015, dans son article 54, alin\u00e9a 2, \u00ab La Cour constitutionnelle conna\u00eet des recours en contestation de la r\u00e9gularit\u00e9 des candidatures, des r\u00e9sultats des \u00e9lections pr\u00e9sidentielles, l\u00e9gislatives nationales et du r\u00e9f\u00e9rendum \u00bb.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En pr\u00e9vision du scrutin pr\u00e9sidentiel de d\u00e9cembre 2023, la Commission \u00c9lectorale Nationale Ind\u00e9pendante (CENI), a rendu public le 19 octobre dernier, la liste des candidatures d\u00e9clar\u00e9es recevables.
