C\u2019est un arr\u00eat qui est d\u00e9connect\u00e9 du proc\u00e8s Matata. D\u2019abord, il est de principe en droit que la Cour constitutionnelle ne revient pas sur ses arr\u00eats. Ces derniers sont ex\u00e9cutoires et ne sont susceptibles d\u2019aucun recours. Donc \u00e0 partir du moment o\u00f9 la Cour est revenue sur sa propre d\u00e9cision, il y a un probl\u00e8me<\/em> \u00bb, a-t-il fait savoir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">L&rsquo;avocat de Augustin Matata Ponyo a annonc\u00e9 un possible recours en contestation aupr\u00e8s des instances r\u00e9gionales ou internationales est envisag\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlant de la proc\u00e9dure, Laurent Onyemba a d\u00e9nonc\u00e9 l&rsquo;attitude de la cour face aux exceptions soulev\u00e9es par la d\u00e9fense de l&rsquo;ancien premier ministre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00ab\u00a0<em>Monsieur Matata a dit : je suis d\u00e9put\u00e9, je jouis des immunit\u00e9s. Donc pour me juger, il faut respecter la proc\u00e9dure. Cela n\u2019a pas \u00e9t\u00e9 fait. L\u2019Assembl\u00e9e nationale a pris une position. Nous avons soulev\u00e9 une batterie d\u2019exceptions li\u00e9es \u00e0 l\u2019incomp\u00e9tence et \u00e0 l\u2019irrecevabilit\u00e9 de l\u2019action. Mais la Cour a d\u00e9cid\u00e9 de joindre au fond toutes ces exceptions<\/em>\u00ab\u00a0, a-t-il conclu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Il sied de noter que ce mardi, la Cour constitutionnelle, a condamn\u00e9 l&rsquo;ancien premier ministre Augustin Matata Ponyo \u00e0 une peine de 10 ans des travaux forc\u00e9s. L&rsquo;opposant congolais est \u00e9galement frapp\u00e9 de 5 ans d&rsquo;in\u00e9ligibilit\u00e9, ainsi que 5 ans de privation du droit de vote et du droit \u00e0 la lib\u00e9ration conditionnelle.
